These Terms of Service (“Terms”) govern your access to and use of the Fashion Fast mobile application and related services (collectively, the “Service”) operated by Fashion Fast LLC (“Fashion Fast,” “we,” “us,” or “our”).
By accessing or using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with permission from a parent or legal guardian.
2. Accounts
You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Providing accurate and current information
We may suspend or terminate accounts that violate these Terms or pose risk to the Service or other users.
3. The Service
Fashion Fast provides a platform that helps users request same-day delivery of fashion items from participating retailers and boutiques, fulfilled through delivery partners/independent drivers.
Retailers, pricing, availability, and inventory may change without notice.
4. Orders, Substitutions, and Availability
- Items may be out of stock or unavailable.
- Retailers may fulfill your request with reasonable substitutions when allowed by the Service, or cancel an unavailable order.
- You are responsible for reviewing order details before submitting.
5. Fees, Payments, and Taxes
- You agree to pay applicable charges including item cost, delivery fees, service fees (if any), taxes, and tips (if applicable).
- Payments are processed by third-party payment processors.
- All charges are final except where required by law or explicitly stated in a refund policy in the Service.
6. Cancellations, Returns, and Refunds
Cancellation and refund eligibility depend on:
- Whether an order has been accepted, picked up, or delivered
- Retailer return policies
- Safety and fraud controls
Where available, refunds will be issued to the original payment method. Certain fees (such as delivery or service fees) may be non-refundable.
7. Delivery and Timing
Delivery times are estimates and not guaranteed. Traffic, weather, retailer preparation time, and driver availability may impact timing.
You agree to provide accurate delivery information and to be available to receive items. If delivery cannot be completed due to incorrect address or unavailability, additional fees may apply and/or the order may be canceled.
8. User Conduct
You agree not to:
- Use the Service for unlawful purposes
- Harass, threaten, or abuse retailers, drivers, or others
- Interfere with the Service or attempt unauthorized access
- Submit false or fraudulent orders or payment information
9. Third-Party Services and Retailers
Retailers, drivers, and third-party services may have their own terms and policies. Fashion Fast is not responsible for third-party actions or omissions beyond what is required by applicable law.
10. Intellectual Property
The Service, including its content, branding, logos, and software, is owned by Fashion Fast or its licensors and protected by applicable laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our permission.
11. Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the maximum extent permitted by law, Fashion Fast will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses arising from your use of the Service.
Our total liability for any claim arising from the Service will not exceed the amount you paid to Fashion Fast for the transaction giving rise to the claim (if any) during the three months before the event.
13. Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms or if we determine your use poses risk. You may stop using the Service at any time.
14. Governing Law
These Terms are governed by the laws of the United States and, to the extent applicable, the laws of the State of New Jersey, without regard to conflict of law principles.
15. Changes to These Terms
We may update these Terms from time to time. We will update the “Last updated” date at the top of this page. Continued use of the Service after changes means you accept the updated Terms.
